END USER LICENSE AGREEMENT (EULA)

This License Agreement ("Agreement") is between FlyJSim, a company located in the United States ("FlyJSim"), and you, the end-user ("Licensee") of the software known as "Q4XP," designed for use with the X-Plane 11 and 12 flight simulation software and including all accompanying documentation, updates, and upgrades (the "Software").

  1. License. FlyJSim grants Licensee a non-exclusive, non-transferable license to use the Software for personal and non-commercial use only on computers owned or controlled by Licensee.
  2. Restrictions. Licensee shall not use the Software for commercial purposes, distribute, or modify the Software, or create derivative works of the Software, without written authorization from FlyJSim. Notwithstanding the foregoing, Licensee may stream their use of the Software on platforms such as Twitch, YouTube, and Discord.
  3. Intellectual Property. The Software is the property of FlyJSim and is protected by copyright and other intellectual property laws. Licensee agrees not to remove any proprietary markings on the Software.
  4. Term and Termination. This Agreement commences upon Licensee's acceptance and continues until terminated by either party. FlyJSim may terminate this Agreement if Licensee breaches any provision. Upon termination, Licensee must cease all use of the Software and destroy all copies.
  5. Disclaimer. The Software is provided "as is," without warranty of any kind, either express or implied. FlyJSim does not warrant the accuracy, completeness, or efficacy of any flight models or systems in the Software, nor does it guarantee that the Software will meet Licensee's requirements or operate without interruption or error.
  6. Limitation of Liability. FlyJSim is not liable for any indirect, incidental, special, or consequential damages arising from use or inability to use the Software. FlyJSim's liability shall not exceed the amount paid by Licensee for the Software.
  7. Governing Law. This Agreement is governed by and construed in accordance with the laws of the state in which FlyJSim is located.
  8. Application of the Software. This software simulation and its associated manual are for entertainment purposes only and should not be used for real world navigation, flight operations or training.
